X-Pole Wins 5 Figure Legal Settlement.

X-Pole has won a decisive legal battle against a UK company importing Copy/Fake X-Poles and using Vertical Leisure/X-Pole copyright photos and text.

The UK company concerned had imported fake X-Poles from a company in China claiming to be the X-Pole manufacturer. They then used the X-Pole name, inferred that the product was X-Pole, used copyright text and X-Pole copyright photos to market the fake products. In addition the fake product the breached X-Poles product international design rights.

The company, on being advised by Vertical Leisure that they were committing offences, denied the situation at which point Vertical Leisure entered into legal action against the company and its Directors. Certain aspects of copyright infringement are criminal offences which the director of an infringing company are personally liable for.

Customs and Excise and Trading Standards also took the importation of fake product, copyright infringement and misrepresentation extremely seriously and investigated the company concerned, a situation that no company needs.

After legal action was taken and the company was proven to be a fault, it eventually, thousands of pounds later, admitted liability. Vertical Leisure received a 5 figure sum representing damages and legal expenses.

Warning - Following this successful legal action Vertical Leisure / X-pole will now be taking action against ANY company who infringes X-Pole patents, design rights or copyrighted text and photos.
